Hybrids Part 2

The Fallacies of Hybrids

Hybrids are, as I stated earlier, new products.  New products produced with newly attained materials fabricated into a collection of parts to create the whole that is a hybrid vehicle.  There is an amount of recycled material that is used, and to the credit of those companies that ratio continues to rise with every new generation or introduction of a model.  However, hybrids have one large issue that conventional vehicles, petrol or diesel, do not have; batteries.  That’s right, their strength is also their weakness.

So why are batteries a bad thing?  Clearly they help hybrids achieve a higher mileage than their petrol-powered counterparts despite their weight.  However, as I’ve said earlier, mileage is only one variable of the carbon-footprint function.    Consider what it takes to produce those batteries.  To simplify an explanation, I’ll focus on the most popular hybrid, the Prius.  Prius’s use nickel in its batteries.  The main source of nickel is in Canada and extraction of the element from the mines is notoriously harmful to the environment causing acidic rain and air pollution.  Once it is dug up, it is then shipped to Europe to be refined.  From there, it is shipped to China to be further refined, and then installed in the vehicles in Japan where the cars are finally shipped to the US.  All of that pollution from the factories and the transporting ships and trucks that the nickel causes with its global trip is staggering.  Mind you, nickel itself is considered an environmental hazard and that creates yet another risk as the material travels around the world.  Regular lead-based batteries aren’t safe either, in fact they’re considered more hazardous, but at least they aren’t shipped over oceans to go into your vehicle.  And again, no one ever claimed them to be “green”.

Another factor that bothers me is the efficiency and the principle of it all.  True, they are in general more fuel efficient than petrol vehicles, but not by enough in my opinion.  Perhaps I just need to wait longer for automotive engineers to improve the systems even further as the technology has only been effectively used for little more than a decade.  A quick look at the specs between a 2nd gen Prius and a 3rd gen Prius indicates how well we have improved over the last few years.  However, other alternatives such as diesel are still just as or more fuel efficient than hybrids and it shows in markets such as Europe which sells more diesels than petrol automobiles annually.  For an example, the Prius achieves mid-50s mpg rating but a diesel VW Polo can achieve over 70.  This is not a case for diesel’s superiority but more as evidence that hybrid systems are not the only solution to obtaining high mileage figures.  But what about the principles of it all?

This is what I feel many people miss.  I fear too many people see hybrids as an answer and are too short-sighted or too afraid to fully attack the main issue; oil.  Take for an example the Chevrolet Volt.  When the model was first announced, it was to be a full electric vehicle and I was happy to see Chevrolet putting to use that talent pool they have hidden in Detroit on other cars other than the Corvette.  Then they decided to just make it a hybrid and I remember audibly calling them “A bunch of [w]ussies” when I first read it.  Mind you, GM has produced an electric vehicle before and despite safety concerns and their questionable repo methods, it could be seen as a success.  What it and the original Volt are doing is creating a source of transportation that doesn’t require any form of petrol or diesel at all and that is what I believe more companies need to make a priority.

I understand that producing an electric or fuel-cell vehicle isn’t that simple and I also acknowledge that the batteries that I just complained about will be used once again questioning how environmentally friendly these machines really are.  However, in the long run I believe they are the answer and that we should stop fooling ourselves and wasting our time with band-aids like hybrids.  It will take time to transform into a society without gas, but if we continue to make vehicles like the Honda FCX Clarity or BMW Hydrogen 7 as replacements for traditional daily transportation then it is a stronger step in the right direction towards solving a problem.  Come on automotive industry, get bolder!  But what should an environmentally conscious person who’s looking for a car do?  What should a true green-minded individual purchase if they shouldn’t buy a hybrid?  Stay tuned for the concluding part 3.

I don't "do" Black Friday

It scares the wee out of me.  Aggressive trampling crowd, elbows flying, sprints to endcaps, a tug of war over the last one, where you end up beaten bloody on the floor -crying Mama – while you rock back and forth sucking your thumb.

Um, no thanks!  Okay, I’m sure that’s not what really happens, but I have no desire to find out otherwise. I’ll just lounge in my PJs, thankyouverymuch.

Yesterday was my first Thanksgiving with Jason’s family. His mother graciously welcomed me, my mother, and my daughter Sydney to the grand feast.  The table was decorated with ceramic pumpkins, fancily folded napkins in rings, and beautiful china. The food was a foodie lover’s dream, so friggin’ delicious. She went above and beyond. That is one mother who LOVES with all her heart, and it spills over into all the hard work she puts into this Thanksgiving dinner for her family.

Even more beautiful was the children racing around, giggling, screeching, and constantly filling their bellies. I have decided my delight in  children comes from a long line of family genes. Goes back as far as we know to teachers in the previous generations. Except it ended with me, because I loved travel more, but I digress.

I got a kick out of watching my mother, mingle, laugh, and enjoy the meelee. Most of the children in our family are grown, so this was a sight to see and reminisce.  It was eerie how well she fit in. But I’m not surprised. Good people with the same values, and upbringings as ours, which is why I love them so much.

Good Friday kicks off the start of the countdown to Christmas.  Good Friday is a shoppers dream. Good Friday reminds me of the time my car was broken into. I was running on the trails in Fort Worth.  It was somewhere around six or seven miles.  I get back to find a policeman next to my car which has a shattered drivers side window.

That wasn’t even the worst of it. My purse was in the car. Yes, I know -  how dumb. I went to the back hatch opened it, popped the hidey hole, and voila there was my purse. Then I checked the middle console where my keys were (to the car, house, etc). Yep! Still there. Oh the cop was none to happy about that, but seriously – jogging with a big wad of keys? – or jogging with a very small remote to the car? Yeah, I chose remote – shamefully.

I was very lucky. I never parked there again, and at the time – I wasn’t sure I’d ever get to jog again. Husband 2 was a tyrant. He went ballistic over this infraction. Of course, it was my fault, and I was never to jog again, EVER. Insurance does not pay for that, so we had to fork over a few hundred dollars. Some Black Friday, huh? See why I don’t like them.

But the gift was that it could have been so much worse, being my purse was in the car, and keys. All I lost was a lousy tinted window.  I have never parked there again, in fact, I started parking in a shopping center and walking to the trails. I never, ever took my purse with me.  So, it all worked out, I got to keep running at my favorite park and learned some valuable lessons.

That brings me to what I promised myself, that I would begin a series of posts,  from now until Christmas titled Timeless Gifts. You know what those are – things you can’t price – just revel in the majesty of the gift. Instances of  kindness that blow you away, or movement of the season to make you really realize what Christmas is all about. An unbelievable act that has you falling to the floor, shouting  “I’m not worthy!”  Yeah, those kind.

I have a lot of those in my life. The car breakage is one.  Can you imagine right before Christmas to have your I.D and bank card stolen? It would have made for a tough time, to deal with all that, and wonder if you’d ever be safe again – not to mention the fallout, and punishment from #2.

I, for one, was very grateful it wasn’t that bad and still am. My eyes were opened to the Timeless Gifts that happen all around. I hope I can share them with you. I hope I do the stories justice in the coming weeks. Until then….

Ikea

So yesterday we went to Ikea for a little shopping. When we arrived a man ran up to us saying ‘Want your car washed for €6?’ I thought that’s cheap, so I got it done. Also I paid €2 more for the wheels to be cleaned.

We went into the shop, got all the shopping, which was a lot of shopping btw. When we came back to the car, sure enough it was clean. Not as clean as I expected, but ok. It is a chemical wash remember, no water is used. So there are swirl marks. I have to say, I wouldn’t get it done again. Why? I hear you ask.

The chemicals used are ment to get dirt off paint-work. Now that means someone has to wipe the dirt off the car, which means their cloth becomes like sandpaper while wiping the car. That’s why there are swirl marks on the car that wasn’t there before. Also the wheels aren’t €2 clean. I’ll save my €8 next time and go to a proper car wash.

Some require you to agree to their using a photocopy service to copy your records at a higher cost. Some medical providers require one fee for your bills and another fee for your medical records.

Just obtaining all of your medical records and bills is one of the most time consuming aspects of handling personal injury cases. And, to make matters worse, you’re still not through with your medical providers. When your treatment is complete and you have all of your medical records and bills and the first settlement offer is made to you, you’ll need to call each of your medical providers or their billing offices again to learn if you have any balance owing (and you can expect to be on the phone repeatedly and for long periods of time to learn this information) and in many cases you will need to send them another authorization form before they’ll tell you this information.

You will need to obtain a copy of the police report. This is a much simpler process. Some police departments charge between $10 to $40 for a copy, while other departments provide them to you for free. You can pick it up at the police or CHP office yourself or request one by mail with an authorization form and a check for the proper fee.

You’ll also need to obtain your wage loss information on a wage loss form from your employer if you suffered any wage losses or had to use up valuable sick time, personal time, or vacation days.

You should obtain witness statements if there is any issue as to the liability of the other driver for the accident and you should take photos of the scene if there was something wrong with the road conditions or other unusual circumstances.

You will also need to obtain a number of good photographs of your car damage, copies of the vehicle repair bills and estimates and receipts for any items damaged in your vehicle.

Here’s a secret. In California you are entitled to the cost of a replacement child seat if one was in the accident. It’s automatic. Just tell the insurance company the make and model or find out the cost for the make and model child seat and the insurance company will send you a check for a new one, even if the old one wasn’t broken. Why? It’s in the California insurance code. The insurance companies, however, don’t volunteer this information. Why? They’re in business to make money, not pay it out.

Finally, when all your treatment is done, you will need to put together a demand package with a demand letter reviewing the facts of the accident and the negligence of the other driver that made him or her at fault, a summary of your injuries and medical treatment (from your medical records), an itemization of your medical bills, a discussion of your pain and suffering and how the injuries impacted your life, a discussion of your wage loss and how you determined the amount, and finally the amount of your demand and a time limit (40 days – the time allotted under the insurance code) for the insurance company to respond with their offer. The demand letter should be a minimum of four pages in length. Some of ours have been close to twenty pages. Accompanying the demand letter should be copies of all of your medical records and bills, color copies of the car damage photos, copies of the repair bills and estimates, any wage loss documentation and any other relevant items such as witness statements, etc.

If all of this is too much work for you to accomplish (and it is a lot when you are just trying to get better, get on with your life, raise a family and still go to work to put food on the table) you may want to hire our law firm to represent you.

The reason why, in most cases you will receive more, even after an attorney’s fees and costs are taken out, is that insurance companies offer much more to an attorney handling your case than when you are attempting to settle it yourself. Sadly, many of these same lawyers take this step or let their improperly trained staff members (secretaries and clerks) force the matter to such an impasse and then file suit without properly informing the client of the negotiations that took place and led them to that point.

If you are negotiating with an insurance company yourself, there’s no need to be unpleasant. Yes, you are probably going to hear that the insurance adjuster has evaluated your case to be worth much less than you think it’s worth. But you’re forgetting that, that’s just their first offer. Communicate with the adjuster. Tell them how the injuries affected your life and tell them what you still go through today with the pain you still have. You’ll be surprised how many adjusters will actually relate to what you tell them.

Unfortunately, just as there are bad attorneys out there, there are also some lousy insurance adjusters and insurance companies to deal with as well. They’re supposed to get back to you in 40 days with an offer after you present them with your demand package. Some take longer. Some will sound unpleasant, even snotty. And once they make their first offer, it can take weeks sometimes to reach the adjuster again to make your counter-offer. Sometimes the negotiations can take months. If you want to get the most you can for your case, you need to be patient. Your job, just as it is the job of your attorney, is to get these unpleasant insurance adjusters to warm up. I ask them how the weather is, how they’re doing, if their busy, anything to get them to open up to me. You’d be surprised how far a little kindness goes.

Vision Board

I was ransacking my things days ago (see previous entry) and I came across this Vision Board I made when I was still studying. It was an assignment from my Christian Living sort of class, I don’t know what the course was called exactly because I never paid attention to religion themed courses, but the whole thing was about how God made everything and how we should live very saint-like christian lives. Yes, I am exaggerating. You know how I feel about religion. Anyways, were asked to create our own Vision Board, meaning what we think we will be having or what we want to have five years from that day. We had to cut pictures and stuff to make a collage and put it in a 1/8 illustration board. Very highschool, *mumbles* Christians. This was what I came up with:

  • I didn’t have enough materials with me when I was making it because most of our old magazines were either thrown out or sold to junk shops. The only ones left were the ones in my room which was bought years ago. I remember having those back when I was still in grade school.
  • I am a huge fan of Elliott Yamin (E). I have been since his American Idol days, he was only able to take the third place but you know how talented people are. They still get through the industry. And I have such dislike for ‘artists’ who only cater to tweens using their faces as products. He has Diabetes and one of his ears is impaired. He made me want to be a singer more than how much I wanted to before I watched him.
  • There was a point in my confused adolescent life when I wanted to audition in a local singing competition, disregarding how crappy they are and disregarding how I am relatively less talented than most, and possibly make it and sing. I was deluded. But now that I think about it, that doesn’t seem to be a very bad idea. Hmm.
  • I think I am enjoying these bullets. This is the second time I posted an entry using them. :P
  • New York = Broadway. Someday I will go there to watch my favorite musicals no matter how much they will cost me. I am such a cliche. Of course I have to make money first. I just got inspired to perform a bank heist after writing this.
  • I love dancing. Or I love seeing other people dance.
  • Of course, everybody’s dream. Own a car. Do road trips, visit unsuspecting friends and ruin their Sundays. Go wherever like you have no work to get back to. Life is beautiful.

There is much more that an experienced attorney does, especially in the negotiation stage to maximize the settlement and this is where an attorney’s experience kicks in.

An attorney such as Sebastian Gibson who has been negotiating these cases with many of the same adjusters for decades, knows the tactics and negotiating style of them and their companies and knows how refute the talking points their insurance companies train their adjusters to use in negotiations.

What causes many attorneys to be unable to settle their cases and who then find themselves with no alternative but to file a lawsuit in court and face two to five years of litigation before the matter settles or goes to jury, is to get angry (some even scream and yell) with the adjuster, box themselves into a corner and tell the adjuster something along the lines of, “If that’s the best you can do, we’re filing suit.” The adjuster’s response to this is naturally, “go ahead.”

An insurance company doesn’t really care if they have to dump your case onto the case load of their attorneys who are already handling tens of thousands of such cases. One more case, makes no difference to them at all. They also know, you may give up or settle for even less when you learn from an attorney how much just the court costs will be. Just to file a lawsuit in most courts alone incurs a $350.00 or larger filing fee. Depositions can cost over a thousand dollars if they are lengthy. And all such court costs come out of your settlement, even if you have a contingency fee attorney handling your case.

Sadly, many of these same lawyers take this step or let their improperly trained staff members (secretaries and clerks) force the matter to such an impasse and then file suit without properly informing the client of the negotiations that took place and led them to that point.

If you are negotiating with an insurance company yourself, there’s no need to be unpleasant. Yes, you are probably going to hear that the insurance adjuster has evaluated your case to be worth much less than you think it’s worth. But you’re forgetting that, that’s just their first offer. Communicate with the adjuster. Tell them how the injuries affected your life and tell them what you still go through today with the pain you still have. You’ll be surprised how many adjusters will actually relate to what you tell them.

Unfortunately, just as there are bad attorneys out there, there are also some lousy insurance adjusters and insurance companies to deal with as well. They’re supposed to get back to you in 40 days with an offer after you present them with your demand package. Some take longer. Some will sound unpleasant, even snotty. And once they make their first offer, it can take weeks sometimes to reach the adjuster again to make your counter-offer. Sometimes the negotiations can take months. If you want to get the most you can for your case, you need to be patient. Your job, just as it is the job of your attorney, is to get these unpleasant insurance adjusters to warm up. I ask them how the weather is, how they’re doing, if their busy, anything to get them to open up to me. You’d be surprised how far a little kindness goes.

You’ll find that your health, in many cases, will drastically improve, once you remove yourself from the stress of handling your case and resolve it either yourself or with the assistance of our law firm by way of settlement. Accident update.

Just a little update:

It now appears that Fiffy, my Ford Ka, is going to car heaven

I had a call this morning from the car people (just keeping me informed) & the lady basically said that my car is now a write-off.
Luckily, I’m fully-comp, so my insurance company will pay out for a new car, obv not the full amount, but it will help. I’ve already decided that I’m not going to get another Ka, but I’ve always wanted a mini (but they are NOT cheap!) so we’ll have to wait & see, I guess.

"I've Got Some Room on My Lap"

The other night I was walking down L & 21st street with my friend. It was about 11 pm and we had just come from dessert, both of us dressed for a night of hanging out and doing pretty much nothing. Then, out of no where, a black SUV pulls up right beside us and rolls downt he window. The car was full of about 5 guys, in their late 20’s/early 30’s, hollering to us. “Hey baby, I’ve got some room on my lap”, “why don’t you girls just come over here and show us a good time”, among other comments. We began to speed up and grabbed each others arms. Then, as we sped up, the car continued to follow us. I got so sick of it, after about a block, that I turned their direction and yelled “Shut up!” at the top of my lungs. I just stood there for a second and they stoped talking. Then they drove off as fast as they possibly could, as my firend and I gave them the finger. I was repulsed but proud of myself.

The Barrels are Coming! Brilliant New Super Street Fighter IV Shots Emerge

My money’s actually on the car

Street Fighter IV is the first of only two games I ever awarded top marks since I started this whole game journalism gig. So imagine my excitement when the superb team at VG247 reported on a new batch of tasty screenshots for Super Street Fighter IV.

In true Capcom fashion, the ‘Super’ moniker spells a slew of new features; adding more characters, replay modes, ultra combos and a generally tune-up of the entire combat system to balance it even closer to perfection. Although the prospect of adding Final Fight/Street Fighter Alpha character Guy to the roster (go on Capcom, make my day!) makes me very happy, a welcome return of the barrel and car-smashing bonus rounds from Street Fighter II will be just fine for the time being.

Most of the parking space where I live is under trees and that’s what I get on a bad bird-diarrhoea day. Sometimes it’s even worse. Extention of Current Conforming Loan Limits in California.

The U.S. Congress passed a congressional resolution extending through 2010 the current conforming loan limits of $417,000 for most areas in the U.S. and $729,750 for high-cost areas, including many in California.

The CALIFORNIA ASSOCIATION OF REALTORS® (C.A.R.) and the NATIONAL ASSOCIATION OF REALTORS® (NAR) have long advocated making permanent higher conforming loan limits. As a result of C.A.R.’s and NAR’s efforts, a provision of the Housing and Economic Recovery Act of 2008 included temporarily raising the conforming loan limits from $625,500 in high-cost areas to $729,750 and extending the limits through 2009. Yesterday’s actions effectively extend the higher conforming loan limits for Fannie, Freddie, and FHA loans through 2010.

“There is no doubt that higher loan limits and the federal tax credit for first-time home buyers have helped stabilize California’s housing market over the last year,” said C.A.R. President James Liptak. “C.A.R. applauds our congressional representatives for their actions to extend the higher loan limits through 2010. They now should focus on making higher loan limits permanent.”

The conforming loan limit determines the maximum size of a mortgage that Government Sponsored Enterprises (GSEs) Fannie Mae and Freddie Mac can buy or “guarantee.” Non-conforming or “jumbo loans” typically carry higher mortgage interest rates than conforming loans, increasing monthly payments and hampering the ability of families in California to purchase homes by making them less affordable.
