Improve Your Gas Mileage!

//
  • Stay within posted speed limits. The faster you drive, the more fuel you use.
  • Use overdrive gears. Overdrive gears improve the fuel economy of your car during highway driving.
  • Use cruise control. Using cruise control on highway trips can help you maintain a constant speed and, in most cases, reduce your fuel consumption.
  • Anticipate driving situations. If you anticipate traffic conditions and do not tailgate, you can avoid unnecessary braking and acceleration, and improve your fuel economy by five to 10 percent.
  • Avoid unnecessary idling. Turn off the engine if you anticipate a lengthy wait. No matter how efficient your car is, unnecessary idling wastes fuel, costs you money and pollutes the air.
  • Combine errands. Several short trips taken from a cold start can use twice as much fuel as one trip covering the same distance when the engine is warm.
  • Remove excess weight from the trunk. Avoid carrying unneeded items, especially heavy ones. An extra 100 pounds in the trunk reduces a typical car’s fuel economy by one to two percent.
  • Keep your engine tuned. Studies have shown that a poorly tuned engine can increase fuel consumption by as much as 10 to 20 percent depending on a car’s condition.
  • Keep your tires properly inflated and aligned. Underinflated tires cause fuel consumption to increase by six percent.
  • Change your oil. Clean oil reduces wear caused by friction between moving parts and removes harmful substances from the engine.
  • Check and replace air filters regularly. Your car’s air filter keeps impurities in the air from damaging internal engine components. Clogged filters can cause up to a 10 percent increase in fuel consumption.
  • Buy only the octane level gas you need. Remember, the higher the octane, the higher the price. Check your owner’s manual to determine the right octane level for your car.
  • Own a fuel efficient vehicle. The difference between a car that gets 20 MPG and one that gets 30 MPG amounts to $1,500 over five years.
  • Tips:
    1. If you’re dissatisfied with a gas-saving product, contact the manufacturer for a refund. Most companies offer money-back guarantees. Contact the company, even if the guarantee period has expired.
    2. The Environmental Protection Agency (EPA) has evaluated or tested more than 100 alleged gas-saving devices and has not found any product that significantly improves gas mileage.
    3. Don’t be lured by testimonials by satisfied customers using gas-saving products. Few consumers have the ability or the equipment to test for precise changes in gas mileage.
    4. No government agency endorses gas-saving products for cars.
    5. If the seller claims that its product has been evaluated by the EPA, ask for a copy of the EPA report, or check EPA.gov for information.

I'm the cleanest 30-something man in the world!

    Oh yes, I really am.

I had just collected Thumper from his first servicing down at the dealership. The speedometer reading registered 20,300KM just before I turned the car off, which meant to say since I started driving Thumper on September 23, I have done 6,791KM in just a little over three months.

And based on Honda Jazz’s official website, Thumper is producing 159g/KM of nasty carbon dioxide, giving Thumper and I a teeny weensy 1,079,769g of emissions.

    I like even, round numbers...

1,079,769g!! Ask any 30-something bloke and they’d tell you they’ve been driving for more than ten years!! That’s easily 40 times more than 1,079,769g!

    1,079,769g!!

That’s over a tonne of crap dumped into the environment! And I’m only a humble man who only picked up driving because his wife is up the duff!!

We are all guilty of slowly killing the planet, and until September 23, I had absolutely no carbon footprint (from a car’s point) to speak of. It really puts things in perspective.

But for the time being, let me revel in my joy at being the cleanest 30-something man in the world.

    I really am!

    Car Security Types

After spending your hard earned money on a vehicle that you love and appreciate, it only makes sense that you will want to do all that you can in order to keep it safe and protected. Security is something that comes for a price but it is worth it when you can have peace of mind as a car owner. Car security should not be rushed into without a second thought.

alarm. This is the best car security system, consider asking your insurance company what they recommend. They will often have some helpful suggestions for you. Consumer product reviews are always great for getting some insight from other buyers. This is the kind that will alert you with a loud sounding alarm if someone should try to tamper with your car. Many people find these types of alarms to be somewhat annoying because they are sensitive and can go off over little things that are unimportant like loud noises.

Another form of automotive security system is the best car security is the best way to determine both good and poor products. You should pay attention to the price of things too. Cheap often means low quality but you do not always have to buy the highest price item either. Choosing proper car security system. They are all quite different so spend some time researching the various brands and types so that a thief will not be able to guide you in other ways. You can present the list to a professional that will alert you with a loud sounding alarm if someone should try to tamper with your car.

Many people find these types of alarms to be somewhat annoying because they are sensitive and can go off over little things that are unimportant like loud noises. Another form of automotive security system is the inaudible system. This one does not go off over little things that are unimportant like loud noises. Another form of automotive security system for your automobile. If you are not close enough to get to your cell phone so that you know the alarm has been set off. There are certain disadvantages to this type of alarm though.

    #18 - Washing One's Car

Unfortunately winter is upon us, which means that the time of the year during which one can wash one’s car has basically ended.  Alack!  For the chance to wash one’s car is truly one of the greatest pleasures offered by car ownership, aside of course from speeding on country roads or from having an excuse to buy/own driving gloves.  “But,” you might say, “I don’t want to wash my car.  Washing my car is tedious and boring,” to which I’d respond with something offended along the lines of No, it is you who is tedious and boring! See, here’s the thing: we live in a world in which possession of materials (and the attendant dependency thereupon) is more or less unavoidable.  We also live in a world in which these material things upon which we depend, and around which we arrange our lives, are prone to decay, i.e. everything falls apart.  One can, however, belay to some extent this decay of the possessions one possesses by maintaining them – laundering one’s clothing, polishing one’s inherited silver, washing one’s car.  And while one could easily take one’s car to a car wash – drive-in mechanical car washes are admittedly fun – washing one’s car by hand, as in with a bucket filled with a solution of Murphy Oil Soap & water, is so much more pleasurable.  When one’s finished washing, and drying with old rags, one’s car, and when one has driven one’s car very fast indeed around one’s neighborhood to deal with any errant water droplets, one can then bask in the pleasure of seeing how clean and shiny one has just made one’s car, in a job well done etc. Also, it’s really easy and free, and you look like you need some fresh air so, you know, suck it up.

    all out or save some?

Me and my good friend Martin were having a conversation early on Christmas morning about my previous post “Yes, BUT…”

Shortly after posting “Yes, BUT…”, he made his own post on his WordPress blog, wherein he compared relationships to the building and reconstruction of a car. He’s in the process of moving on, and the best way he could explain how he was coping, was to compare it to a car. He said, and I quote,

“I got the engine to fit in, and now bolted on the transmission. Time to connect the necessary lines and cables to the engine to give the car life. I’m so excited to fire it up. When this thing starts, the next step would be the paint job, and upholstery. The last part would be adding the necessary fittings to complete it. I cannot wait to complete this thing. I wanna go out and let the tires burn on smooth asphalt. ”

He told me he felt like he had just gotten out of a totalled car. In a relationship, when you give it all you’ve got, and the relationship fails, it hurts. Big time.

Why even make yourself vulnerable to that kind of pain?

Because if it succeeds, it feels good. Big time. It’s like poker. When you bet small, win or lose doesn’t really matter much. When you go all in, you either win big or you lose big.

Is the risk of losing when going all in really worth it?

Could you get out of the totalled car?

Impact on Seniors No Longer Able to Drive

There is a freedom and independence many of us to take for granted that comes with being able to grab your car keys, jump in your car and drive to wherever you want or need to be.  Unfortunately, the older we get the more difficult it becomes to stay behind the wheel for a variety of reasons, but largely due to declining eyesight, hearing and reaction times.

How does this loss of independence effect the senior population?

A recent article featured in The Boston Globe titled, “Off the road,” discussed both the physical and emotional effects that result when an elder is no longer able to drive.  Sadly, the article explains that “there is an increased risk of depression, isolation, and even, studies suggest, of ending up in assisted living.”  Some studies, most notably by geriatrician Richard Marottoli, an associate professor of medicine at Yale University Medical School, have found an increase in depression and a drop in out-of-home activity levels among older adults after they surrender their license.

This begs the question.……what next?  Considering what these studies have shown, what alternatives are available for these seniors?

As Boomers face the driving dilemma with their parents and as they get closer to dealing with this issue themselves, there is a growing need to develop more comprehensive transportation alternatives that will allow seniors to retain some of their independence and allow them to remain engaged outside of the home.

Elinor Ginzler, the AARP’s senior vice president of the livable communities initiative, says that despite the impeding number of aging drivers (roughly one in four will be 65 or older by 2025), “many local, regional, and state agencies are failing to include alternatives to automobiles in their planning.”

A ray of hope: the article featured a fantastic service called Independent Transportation network, a 24-hour driving service run by volunteers which allows seniors who surrender their car to the network to receive the equivalent of the vehicle’s value in free rides.  Or you can simply join without the trade in and pay by-the-ride (which is about half the cost of a cab fare for the same route).  In the 14 years since it started, the group has organized 280,000 rides nationally.  Founded in Maine, the program has now spread to communities in 10 other states.

Peugeot Car Bike... 118 miles per gallon!!!

A hybrid motorcycle… 118 miles to the gallon… Peugeot. Part of me thought those 3 things would never go together in the same sentence, but low and behold while i eat my words… A large automaker in Europe has come up with the HYmotion3.

This car/bike provides some protection from the weather with a glass canopy and it also allows the driver to have some fun, with its ability to really lean in to the curves. The three wheel drive is better for safety and driveability that a regular motorbike. Peugeot is a fine example of French craftsmanship and this HYmotion 3 might not be the same as a Peugeot 308 in Hampshire but in a world of intensifying urban traffic where everyone is trying to save time and petrol prices are on the constant rise, then this HYmotion 3 is the perfect future scooter.

    Loads of Travelling

Once again it’s copious amounts of car time. The last three weeks have been just one constant road trip after another with a couple of days at home. The kids are beginning to notice my absence. I picked up a hamstring injury preparing for a marathon in November and thanks to all the car time it’s not really improving, it just seems to rotate around and around the upper leg and hip. Bummer.

I’ll just have to parcel up some sympathy and leave it under the christmas tree for Christmas day. Mmm, some sympathy, with a few glasses of Connemara Peated Single Malt, some good food and the kids creating havoc. All this before 7am. Never mind the hamstring, bring on the nut loaf…

2011 Ford Mustang GT: Feel My Power!

Now with more bad ass fewer give-a-damns!!!

Just in folks!!! The 5.o liter V8 that Ford is dropping into the 2011 Mustang will be churning out 412hp!

What’s that, you say? Not as much power as Camaro and Challenger? Dude, like it matters!! The 4.6 liter V8 was never too far behind the Camaro 0-60 time and just ahead of the Challenger’s.  Need I remind you, that was back when the Mustang only had a 315hp answer for 422-426hp of the competition.

412hp isn’t as much as 426, but the Mustang started out being lighter than both of it’s rivals.  Even if the 5.0 liter V8 weighs more than the old iron 4.6 (it shouldn’t because the 5.0 is aluminum), it won’t be enough to matter.  This isn’t just a chess game of power numbers, but of power-to-weight ratios.

The Mustang had the new muscle market corner right until the Challenger hit the streets.  Then the Camaro put up it’s dukes and claimed superiority in 2009.  But like a lot of things in the universe, the car industry is cyclical, and the Mustang is poised to be the leader of the pack again in 2010.  Oh look! A rhyme!

How Long You Have To Sue Under Civil Procedure Code Section 335.1 Explained By Lawyer - The California Dog Bite Statute of Limitations

The California Dog Bite Statute of Limitations is contained in Code of Civil Procedure Section 335.1. It applies to accident cases, injury claims and wrongful death situations. This is the statute that tells how long, i.e., how many years a person has to file a lawsuit and sue someone who has negligently caused an injury to or death of another in an accident. Those cases to which this statute applies include accidents of all kinds – auto, truck, motorcycle, bike, car, pedestrian, bicycle, slip and falls, dog bites and wrongful deaths. The statute is also applicable to actions for assault and battery caused by the wrongful act or neglect of another and to actions for defective products, also known as product liability cases.

California Code of Civil Procedure Section 335.1 provides:

335.1. Within two years: An action for assault, battery, or injury to, or for the death of, an individual caused by the wrongful act or neglect of another.

The statute thus means that an individual has only two years in which to file a lawsuit for their damages resulting from a personal injury or wrongful death. When the statutory time, in this case, two years, has passed, a person loses the right to file a lawsuit for their damages or other relief.

If you’ve been injured in an auto, truck, motorcycle, bike, pedestrian or car accident, or if you’ve lost a loved one in a wrongful death vehicle accident, call our offices for a free personal injury consultation by phone. You can also e-mail Attorney Sebastian Gibson at SgibsonEsq@aol.com Additionally, we invite you to visit the Sebastian Gibson law firm website for more information at www.SebastianGibsonLaw.com

When does the statutory time period start to run? Normally a statute of limitations starts on the date of the injury. However, there can be exceptions to the rule, for instance in medical malpractice cases.

General exceptions to the rule include the following. If the party at fault for the accident is a public entity such as a city, county, state, school, or public transport service, just to give a few examples, a claim must be made against the public entity within 6 months. There are additional time limitations in which to file a lawsuit after a public entity denies the 6 month claim. There are also different time periods for cases based upon exposure to asbestos.

The statute of limitations can also be tolled (stopped from running for some period of time) if the injured person was not mentally competent at the time of the accident but this does not mean that because an injured person was hospitalized, on medication or drunk or even unconscious for some time that the statute will be extended in these circumstances.

Minors have a longer period of time to sue. The statute is extended for minors and they may bring an action for a period of time after their 18th birthday. To be safe, any such lawsuits should be filed by the injured person who was a minor at the time of their accident, within one year after their 18th birthday if it has not been filed previously by the parents of the minor. Also to be safe, any claims against public entities should still be filed by the parents of the minor within 6 months of the accident. Although many attorneys believe that a minor has two years after their 18th birthday to file a lawsuit due to the change in the statute of limitations for adults some years ago, our advice is not to wait that long in case the statute is applied oddly by some court down the road, especially to accidents occurring prior to the change in the statute.

There are different statutes of limitations which apply to medical malpractice cases and the rules for minors in such cases are also different. As our law firm does not specialize in medical malpractice, it is best to consult with a medical malpractice attorney regarding those statutes of limitations.

The statute of limitations is also different for cases involving childhood sexual abuse and cases involving libel, slander, false imprisonment, fraud and the many other non-tort areas of law, such as in contract and real estate actions, debt collections and in criminal cases.

A claim for damages for a personal injury, such as an auto accident, can, of course be made at any time after an accident to an insurance company or the person who caused the injury. However, if the matter has not been settled before the period of time in the statute – two years, the right of the injured person to be paid for their injuries and to file a lawsuit will be extinguished. As an example, if a person notifies an insurance company of their injuries soon after an accident but the matter is not settled by the time the two year period is up and no lawsuit is filed by the individual within the two years, the insurance company will have no obligation to pay the injured person, even though a claim was made and even if there were negotiations, if there was no settlement.

Due to how insurance companies treat individuals without an attorney, however, a person injured in an auto accident should always retain an attorney to represent them at the earliest possible date after an accident. Unless you haven’t been injured and won’t be needing medical treatment, an experienced and reputable personal injury lawyer will almost always be able to obtain a considerably larger settlement from an insurance company and a larger amount for you, even after the attorney’s fees and costs are paid.

At the Law Firm of Sebastian Gibson, we work on a contingency fee basis, which means that unless we obtain a settlement or judgement in your case, there is no fee payable to us. Even if we’ve incurred costs, such as the costs of obtaining your medical records, no fee is payable to us, unless we obtain a settlement or judgement in your favor. Starting with the personal injury consultation which is also free, and which can be by phone or in person depending on our mutual availability, you never receive a bill from us on any case we take on contingency. Unlike other attorneys who ask you to pay the costs involved with your case, we simply don’t believe you should have to pay those costs yourself.

We’ll also advise you how to obtain reimbursement for your car repairs or if your vehicle is totaled, for the value of your vehicle, and any amount you receive for the vehicle is yours to be used by you for the repairs or to replace your vehicle. At the Law Offices of Sebastian Gibson we never take any portion of your property damage settlement and we can also advise you how to obtain payment for a new child safety seat if one was in use at the time of the accident.

At the Law Firm of Sebastian Gibson, we specialize in California accidents and personal injury law, and will represent you to obtain the compensation you deserve for your injuries.

    Types of Car Security Systems

When you purchase a car, it is not uncommon to become concerned about its protection. After personal security and the security of your home, the security of your car is certainly one of the most important security issues for many people. Hydrogen road car goes into production

We’ve spent a lot of time looking at concept cars over the years, and getting very excited about the possibilities of seeing them on the road someday, only to be cruelly disappointed when they never materialise.

Well this Hydrogen-powered car from Mercedes is actually happening, so we thought it deserved a mention. Called the B-Class F-Cell, it may not be particularly beautiful or fancy, but it is still a pretty impressive little car.

It is of course a hybrid, but one that manages 85mpg, blowing the Prius out of the water. And it has the performance of an average 2.0l petrol car, which is far from shabby. There are only 200 being made for the moment, but a full run is due to start in a couple of months.

Let’s just hope we aren’t to be disappointed once again.

    Windshield wipers

I am ashamed to admit I spent a few hours today reading about windshield wipers.  I am a nerd, so it shouldn’t be surprising that I was drawn to researching something so mundane.

My Prius is still using the original windshield wipers after two years, nine months and 34,000 miles.  These windshield wipers are the nicest I have used on any car.  They are quiet, operate smoothly, and do a good job.  Because of this, I have been reluctant to replace them.  On my old Corolla, I used the TripleEdge blades from Wal-Mart.  They were OK, but not as good as the OEM Prius blades.  I thought about buying the rubber refills from Toyota when the time came to replace the Prius windshield wipers.

The wipers have performed well up to now.  They’re still OK, but there is more streaking than before.  Also, ice got into the assembly and prevented the rubber from completely contacting the windshield during the last snow event.  The pressure on the windshield was uneven, so the wiper didn’t do a good job.  I’ve had this happen on other cars, where the ice prevents the wiper from compressing correctly against the glass.  The quick fix is to just give the wipers a squeeze to crack the ice so it crumbles loose and falls out.

I spent some time catching up with posts on the PriusChat forum, and one of the new topics was by a user looking for new windshield wipers.  Several users mentioned the Bosch ICON, so I checked them out.  It is a bracketless design.  My parents’ Honda CR-V has this type of wiper, but I didn’t know what it was called until now.  This wiper type doesn’t have the little bows that press the wiper against the window.  Instead, the whole wiper blade is a plastic and rubber arc, and there is metal inside that makes sure the blade compresses against the window.  There is nowhere for ice to get trapped in the blade and cause uneven pressure against the glass.

I read other PriusChat forum posts about the ICON as well as reviews on forums for owners of other cars.  I checked out the Amazon reviews too.  These wipers are expensive, like $18-$25 a piece.  I’m used to spending $16 total for both wipers, and I haven’t had to buy any in at least three years.  Most of the reviews of the ICON are good, though some people had trouble with them.  There were some concerns about smearing or durability.  However, several people say these are the best wipers they have ever used, and they lasted two years in one case.  Several mentioned Rain-X.  I use Rain-X.  I learned about it from some storm chaser friends about 10 years ago and have been using it ever since.  If the rain is hard enough (not misting), I don’t have to use the wipers as much as I would without Rain-X.  Here’s a link to a video I made a while back showing Rain-X at work.

While looking at Bosch’s webpage for the ICON, I saw there was a $15 rebate available on a set of two wipers.  Amazon only had one of the sizes I need.  I couldn’t find anything that said who else participated in the rebate on Bosch’s site, but eventually saw that O’Reilly Auto Parts is part of the rebate, and their local store has both of the wipers I needed.

If it wasn’t for the rebate, I don’t think I’d go out and spend $40+ on a set of wipers.  With the rebate, it almost makes one of the wipers free and brings the cost back toward the normal range.  My OEM wipers are still OK, and I wouldn’t have a problem with using them through winter.

I’m going to give the ICONs a try, though.  I’m hoping they are as good as the good reviews say they are.  I look forward to the ice-resistant design.  If the ICONs stink, I can always go back to my old wipers and pick up the rubber inserts for a few bucks at Toyota.

But seriously, who spends hours scouring the internet for info on windshield wipers?

One last thing – I can’t believe people buy those crappy wipers that have the red caps on the end.  Those things look so cheap and plasticky.  I think those are the cheapest wipers you can buy at Wal-Mart.  I’ve seen them on police cars a few times and was very disappointed.  Can’t believe someone thought it would be a good or safe idea to put such crappy wipers on a police car.

    More drivers using mobile phones

More drivers are using their phone at the wheel, according to a story on the BBC website. It reports a new survey which found 2.8% of  London drivers were using a mobile phone – up 0.2% on 2006.

Using your phone while driving is a serious matter. You could be fined £60 and get three points on your licence if you’re stopped by the police, and you’re also four times more likely to have an accident when using a phone.

Because it’s often important to make calls when you’re driving, we’ve got loads of great gear to help you do it safely. And it’s not expensive – our Bluetooth headsets start at just £8.99 with free delivery (a perfect stocking filler!) Or if you want something more substantial, check out our range of in car kits (we install them for free too).

The Advantage Of Driving A Home

When it comes to choosing your next car, what kind of things do people usually consider?

    • Leather interior
    • Electric windows
    • Alloys
    • Engine size etc

Well, most people seem to look at these as being a cosmetic factor on choosing which car to buy, or sometimes, what car insurance bracket it falls under, but I’ve never known anyone that has to look at home insurance prices when buying a car.

But then again, it’s not often you look at buying a car that looks like a house.

I guess when it comes down to it, if you had to get insurance for this, what would it be, car or home insurance?

It could be a great way to get two for the price of one, driving your home to and from work, you’ll never be late home again!!

Do you have an opinion on this, if so, please get in touch.

    I bought a new car!

I was forced to finally give up on my well-loved 1995 Nissan Maxima.  14 years and 195,000 miles later, I was still in love with it.  But one day I got rained on — while driving the car!  I have to drive past a quarry every day to go to work, and have had to replace my windshield 6 times due to flying rocks off the back of the gravel trucks that shattered windshield after windshield.  That took a toll on the edge of the roof at the top of the windshield.  Believe it or not, I had rust-through right along that edge, and the rain came in!

So off I went to test-drive new cars.  I’m not very good with salesmen – I’d rather get a root canal.  What a day!  The Nissan folks were very nice and patient, and not too pushy.  The Toyota salesmen were non-existent, I had to go hunting for one.  And they lied about everything when we finally got one to “help” us.   And then there was Honda.  If you look up pushy salesman in the dictionary, you’ll find their picture.  They wanted me to agree to buy a car before they would even show me one!

I was good.  I smiled.  I didn’t yell at anyone.  I didn’t stomp out.  I even tried a Toyota hybrid.  Don’t know how anyone drives them!  I have to merge onto expressways, and cross busy streets without the benefit of stoplights, and the hybrid hesitated so badly accelerating from a stop that I nearly got killed on the test drive.

I tried every Nissan, Honda, and Toyota model available, and in the end I came back to the Nissan Maxima.  The 2010 is a lot different from my 1995, but it still “fits” me.  It felt like an old friend the very first time I sat in it.  And it doesn’t hurt that it’s gorgeous!   I got a great deal, thanks to a weekend of serious internet shopping.  I got it in Ocean Gray, which is a medium greyed blue.  And after 3 weeks, we’ve finally bonded enough for me to give it a name.  I took the name from the lead male character in the movie “Sabrina”.  Either version – Humphrey Bogart or Harrison Ford.  Exactly the right personality.

    Meet Linus.

    [영어산책]Drive Standard to prevent car-jacking

Last November 26, a man tried to hijack a car from a woman here in Winnipeg.

The lady handed the key and asked, “This is standard transmission. Can you drive?”

Then the car-jacker looked, and tossed the key back to the lady and ran.

So, I strongly recommend you to drive standard transmission car to prevent your car from hijacking.

    http://www.winnipegfreepress.com/local/calm-mom-watched-carjack-fail-75724152.html

Automatic Transmission.

How Traffic Collision Reports Use California Vehicle Code Section 23123.5 And How Insurance Companies Interpret Them

In traffic collision reports, a violation of California Vehicle Code Section 23123.5 is one of the Vehicle Code Sections that can be cited as being the primary collision factor for an auto accident in California. This is true whether the accident only caused injuries or if the accident was a fatal accident which caused one or more fatalities. Although a traffic collision report is not evidence, insurance companies treat them as if they are.

California Vehicle Code Section 23123.5 provides:

23123.5. (a) A person shall not drive a motor vehicle while using an electronic wireless communications device to write, send, or read a text-based communication. (b) As used in this section “write, send, or read a text-based communication” means using an electronic wireless communications device to manually communicate with any person using a text-based communication, including, but not limited to, communications referred to as a text message, instant message, or electronic mail. (c) For purposes of this section, a person shall not be deemed to be writing, reading, or sending a text-based communication if the person reads, selects, or enters a telephone number or name in an electronic wireless communications device for the purpose of making or receiving a telephone call. (d) A violation of this section is an infraction punishable by a base fine of twenty dollars ($20) for a first offense and fifty dollars ($50) for each subsequent offense. (e) This section does not apply to an emergency services professional using an electronic wireless communications device while operating an authorized emergency vehicle, as defined in Section 165, in the course and scope of his or her duties.

When a Police or CHP Officer, or a Sheriff’s Deputy states in his or her report either that the primary collision factor in an auto accident was one party’s violation of a certain vehicle code section such as the one above, and that one of the parties is at fault for violating that code section, the Officer or Deputy is stating what he or she believes to be the underlying cause of the accident.

The reason insurance companies treat the collision reports as if they are admissible evidence is that they know if put on the witness stand, the investigating officer or deputy will almost always testify in a manner consistent with the conclusions in his or her report. That testimony becomes evidence and will often sway a jury in their determination of fault for an accident.

While an investigating officer’s job is to determine if there was a violation of the law and not to determine who should be at fault in a civil dispute such as a car accident claim, insurance companies often view these two determinations as one and the same.

A police officer assigned to investigate the scene of an accident does not have the role that a trier of fact does in a courtroom. The officer is not there to render a verdict and determine who is responsible for the damages. Rather, the officer is there to determine if any laws were broken. The officer makes such a determination based on his or her having seen the damage to the vehicles, and having spoken to the drivers and the witnesses when their memories are freshest. He or she is thus often in a position to make a well-educated determination of who caused the accident.

Unfortunately, despite the experience of most investigating officers who are dispatched to the scene of an accident, sometimes mistakes are made by these officers. Quite often one or both parties to an accident will lie to them and an officer or deputy will not always be able to determine which of the parties is telling the truth. The evidence from the scene, while important, may also be misleading as to what actually occurred to cause the accident.

Sometimes an Officer or Deputy cannot determine with any degree of certainty which party was at fault and will cite two possible Vehicle Code Sections, one for each party in a two-party collision, that may have been violated. In that case, the Police or CHP Officer or Deputy will often state that the primary collision factor is unknown.

Even if there are witnesses to an accident, the Officer of Deputy may discount the statements of some or all of the witnesses if they were friends or relatives of one of the drivers.

Although, as stated above, the conclusion of fault by an officer or deputy does not carry the same weight as a determination of fault by a judge or jury, the importance of the citation of this or any other California code section in the police report is that insurance companies treat the conclusions in these traffic collision reports in a great majority of cases as if the conclusions were written in stone and evaluate a party’s claim based on the findings of fault in these reports.

A traffic collision report may be amended by the police department or the CHP where it contains obvious mistakes, such as when the officer or deputy has mixed up the names of the parties. Supplemental reports are sometimes written when new evidence comes to light, such as when a hit and run party is located. But for the most part, most police departments, Sheriff’s offices and the California Highway Patrol will not amend a report when a party complains and states why he or she doesn’t feel they should have been found at fault for a collision. They will, however, in most cases allow a person to fill out a Counter Report, which, unfortunately simply does not carry much weight with an insurance company.

If the Primary Collision Factor for an accident is unknown, one should look on the traffic collision report to see if the Police or California Highway Patrol Officer or Sheriff’s Deputy cited any “Other Associated Factors” in the traffic collision report as having had a role to play in causing the collision. There may have been faulty equipment, as with some truck accidents, or the roadway itself may have been dangerous.

If you’ve been injured in an auto accident in California that has been determined by the investigating Police or CHP Officer or a Sheriff’s Deputy to be the fault of another driver as a result of his or her violation of Vehicle Code Section 23123.5, call the Law Offices of Sebastian Gibson as soon after an accident as possible before important evidence disappears, such as skid marks that are washed away with the rain.

At the Law Firm of Sebastian Gibson, we specialize in California auto accidents caused by violations of the California Vehicle Code, such as this section 23123.5, and will represent you to obtain the compensation you deserve for your injuries.

In over thirty years of practice, Attorney Sebastian Gibson has obtained millions of dollars in settlements and multiple million dollar or larger settlements. We handle auto accident cases on a contingency fee basis so there is no fee payable unless we win your case and obtain either a settlement, an arbitration, mediation, jury, judge or court award.

Due to how insurance companies treat individuals without an attorney, a person injured in an auto accident will almost always receive a greater amount from a settlement, even after attorneys’ fees, if the case is handled from the start by an experienced and reputable personal injury lawyer.

If you’ve been injured in an auto accident, call to speak with a lawyer at our offices for a free personal injury consultation by phone. You can speak to Attorney Sebastian Gibson personally by phone or you can e-mail Sebastian Gibson at SgibsonEsq@aol.com

    Kicking Off The Month Right

December is one of, if not my absolute, favorite months. Why? Snow, Christmas, family, vacation–you get the picture. Thankfully yesterday was perfect for kicking things off. My breakfast(pumpkin oatmeal with smart balance peanut butter and maple syrup and a chobani with blueberry jam and double chocolate pillow) filled me up amazingly well. I was not at all hungry after class got out, so I thought I’d seize the opportunity to go to Eastside Market and Whole Foods! Would you believe me if i told you it’s been over 2 weeks since I walked that way? It has! On the way, I came across the best car:

    LDYINRED

Would it be awful to paint this car blue as a very involved April Fool’s joke? Probably. First up was Eastside, which looked mostly the same. I noticed they had brown rice sushi now, which might or might not be new, and for less than $5! I grabbed some for lunch and moved through fairly quickly getting just “the essentials”. Then I hopped over to Whole Foods and was psyched to find this.

    December Whole Deal

There’s a new Whole Deal! But it has some pretty awful coupons :-( I would majorly suggest stocking up on the old ones before you can’t get them anymore. Again, I tried to be quick and dirty shopping here so as to get back to my dorm. Thankfully, it’s a small Whole Foods and not much changes. I couldn’t even find a single Tofurkey roast :-( Maybe hunting season’s over? I got back at 1:30 so as to only miss half of Days, and unloaded the loot.

    Groceries

The Chobani and banana were from the dining hall bought with meal points. Otherwise, it was all from my grocery fund. And while none of it I had a coupon for, I tried to just get sale items and things that were “essential”. Here’s a question: when did I become the type of person who considers fake bacon an essential? The only thing that was really an impulse buy was the Carrot Cashew Ginger soup which, for 75 cents a serving, I was willing to try. I also got this one last thing:

    Advent Calender

An advent calender! Frankly, I was a little saddened to find that the 99 cent advent calenders my mom always got us had artificial ingredients I couldn’t eat :-( Thankfully, this one is made with all-natural ingredients and fair trade cocoa to boot! Here’s to a delicious 24 days.

Brown Rice Tuna And Salmon Sushi, Carrot Cashew Ginger Soup

My lunch was simple yet amazing. The sushi wasn’t bad at all for $4.89, although I only ever really eat sushi for the fish. I honestly couldn’t care less for the bit of whole grains and small amount of avocado they give you that hardly adds up to a veggie. The soup was delicious! Albeit a little thin. I think I just like stews and thick bowls of oatmeal, but the flavor was rich.

My afternoon felt like a whirlwind. I hadn’t answered emails or read blogs since 9pm Monday night right before my lock-out experience. Rachael Ray, Ellen, Oprah–I think I was there for them all but I wasn’t really “present”. Before I knew it it was 4:30 and I had a rather odd snack craving.

Acorn Squash With Maple Syrup, Cinnamon, And Sea Salt

For some people(here’s looking at you, Heather), acorn squash might not be so weird a snack. For oatmeal and peanut butter boy here, it was. Nonetheless, I complied, cut up my squash, and steamed it in the microwave, adding a little seasoning at the end. It was perfectly spot-hitting. A little later on the munchies came again and I wanted some protein.

Greek Yogurt With Pumpkin Butter And Peanut Butter Chips

18 grams to be exact. For this I just mixed a plain Chobani with Trader Joe’s pumpkin butter and clear liquid stevia and then added on Sunspire chips–yum! It was such a sweet treat. I love the pumpkin butter with peanut butter for a fall flavoring. As for protein, I don’t generally keep close track of all that stuff; I just aim to have at least 3 high-protein sources through out the day, which often end up being greek yogurt or tofu.

For dinner, the online menu for the dining hall was not promising. Really, there was nothing since even one of the main vegetables was beets which I’ve sworn off for 2 weeks. I still wanted to catch up with my friend, Adam, however, since it’d been nearly 2 weeks since we last had dinner with Thanksgiving being last week. Thankfully, he was fine with bringing takeout to my room, where I whipped up this dish:

Tofurkey Loaf Slice, Broccoli, Carrot Cashew Ginger Soup, Orange Zevia

So I like the soup, wanna fight about it ;-) This was a delicious way to serve up leftovers. I was thinking of adding some flax to the soup to thicken it up but I hate playing around with things and so let it be in the end. We caught up on each other’s Thanksgiving and groaned about how ridiculous these next few weeks of work will be and then said our goodbyes to “write papers”(which in my case meant blog). I’m not a terribly political person so I was happy to skip the Presidential address for some serious snackage.

Chocolate Vitatop With Shortcut Cream Cheese Frosting

Oh my God. What have I released? This was sooooo good. Seriously, has anyone else tried this frosting? If anyone made it vegan with Tofutti I would be mondo impressed/intrigued to hear how it worked out. The Biggest Loser was inspiring, as always. I couldn’t wait to see them do a marathon! That’s really going to make me feel lazy and like I need to get a move on that, haha. The Biggest Loser must make me hungry because at 10 I made a large(r) snack.

Whole Wheat Vegan Cinnamon Roll With Cream Cheese Frosting, Yogurt With Cherry Butter, Dried Cherris, And Advent Chocolate

    Advent Chocolate In Smart Balance

If I weren’t addicted to running and a health eater I’m sure I’d be driving my doctor nuts. The roll tasted just like a cinnabon; Afterwards I had a better idea for the chocolate. I love how the advent candy was in the shape of a heart. I hope they’re all fun like that. I pretty much gave up work after this(note how there’s a notebook under that food) and just focused on getting a good night’s sleep. I was also inspired to ask myself after watching the Biggest Loser contestants run a marathon why I hadn’t tried to run farther recently? Unfortunately my answer sucked: time. I’ve just always been focused on getting back to my dorm and making oatmeal too much to go the extra mile. And so this morning that’s exactly what I’m going to do(literally). I’m going to challenge myself to go 16 miles. If I have to walk or slow down I’ll let myself and I’ll give myself all the time I need. But that’s why I’m up posting at 6:30–to take a bit of time pressure off as I head out right now. Wish me luck!

    So so many giveaways…

    Popchip giveaway! Snap, crackle, POP!

Some very sweet nut butters to enjoy.

And an awesome regions best giveaway!

California Vehicle Code Section 23153 Importance Explained by Attorney for Car Accident Injury Victims

A violation of California Vehicle Code Section 23153 is one of the Vehicle Code Sections that can be cited as being the primary collision factor for an auto accident in California. This is true whether the accident only caused injuries or if the accident was a fatal accident which caused one or more fatalities.

California Vehicle Code Section 23153 provides:

23153. (a) It is unlawful for any person, while under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver. (b) It is unlawful for any person, while having 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver. In any prosecution under this subdivision, it is a rebuttable presumption that the person had 0.08 percent or more, by weight, of alcohol in his or her blood at the time of driving the vehicle if the person had 0.08 percent or more, by weight, of alcohol in his or her blood at the time of the performance of a chemical test within three hours after driving. (c) In proving the person neglected any duty imposed by law in driving the vehicle, it is not necessary to prove that any specific section of this code was violated. (d) It is unlawful for any person, while having 0.04 percent or more, by weight, of alcohol in his or her blood to drive a commercial motor vehicle, as defined in Section 15210, and concurrently to do any act forbidden by law or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver. In any prosecution under this subdivision, it is a rebuttable presumption that the person had 0.04 percent or more, by weight, of alcohol in his or her blood at the time of driving the vehicle if the person had 0.04 percent or more, by weight, of alcohol in his or her blood at the time of performance of a chemical test within three hours after driving. (e) This section shall become operative on January 1, 1992, and shall remain operative until the director determines that federal regulations adopted pursuant to the Commercial Motor Vehicle Act of 1986 (49 U.S.C. Sec. 2701 et seq.) contained in Section 383.51 or 391.15 of Title 49 of the Code of Federal Regulations do not require the state to prohibit operation of commercial vehicles when the operator has a concentration of alcohol in his or her blood of 0.04 percent by weight or more. (f) The director shall submit a notice of the determination under subdivision (e) to the Secretary of State, and this section shall be repealed upon the receipt of that notice by the Secretary of State.
